These terms are an agreement between you and 1001762518 Ontario Ltd., operating as Tabwell, an Ontario corporation ("we", "us"). They apply when you use the Tabwell app or website (the "service"). If you do not agree to these terms, do not use the service. Our Privacy Policy tells you how we use your personal information.
Tabwell keeps a record of expenses that you share with other people. It calculates who owes whom. It does not move money, hold money or make payments. When you settle a balance, you pay the other person outside Tabwell, and Tabwell records that you did.
Tabwell does not decide disputes between its users. If you disagree with another person about an expense, you and that person must settle it.
Do not use the service to do these things:
You own the content that you put in the service: expenses, notes, receipts and the other information you enter. You give us permission to store, copy, process and show that content, only to provide the service to you and to the people you share it with. This permission ends when the content is deleted, as the Privacy Policy describes. Content that you shared with other people stays in their records.
You confirm that you have the right to add each person you add to Tabwell, and to share with them the expenses that you share.
Tabwell uses automated services to read receipts and to convert currencies. These services can make mistakes. Check every amount before you save an expense or settle a balance. We are not responsible for a loss caused by an amount that you did not check.
The service is free at this time. If we add paid features, we will tell you the price and the terms before you pay for anything.
The service, its software, its design and the Tabwell name and logo belong to us or to our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app for your own use while these terms apply.
We can add, change or remove features. We can also stop the service. If we stop the service, we will tell you at least 30 days before, so that you can make a copy of your information.
You can stop using the service at any time and delete your account in the app. We can suspend or close your account if you break these terms, or if the law requires us to. If we do, we will tell you why, unless the law does not let us.
We provide the service "as is" and "as available". To the extent the law allows, we do not give any warranty about the service, including that it will be available without interruption or without errors.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for loss of data, profit or goodwill. To the extent the law allows, our total liability to you is limited to the greater of the amount that you paid us in the 12 months before the claim and CAD 100.
These terms do not limit any right that you have under the consumer protection laws of the province or country where you live. If a part of these terms is not allowed by those laws, that part does not apply to you, and the rest of the terms still apply. If you live in Quebec, sections 10 and 11 do not limit our liability for our own acts or our representatives' acts, as Quebec's Consumer Protection Act requires.
The laws of Ontario and the federal laws of Canada that apply there govern these terms. The courts of Ontario can decide disputes about them. If you are a consumer who lives in another province or country, you can also use the courts and the laws of the place where you live, if those laws give you that right.
We can change these terms. When we do, we change the date at the top of this page. If a change is significant, we tell you in the app or by email at least 30 days before it applies. If you do not agree to the change, you can delete your account before it applies.
